New Jersey Unemployment Laws and Establishing Good Cause.

Here is a recent case on New Jersey unemployment benefits applying New Jersey employment law. 25-2-9455 Chen v. Board of Review, App. Div. (per curiam) (6 pp.) Appellant challenges the Board of Review's decision finding him ineligible for unemployment benefits on the basis that he left work voluntarily without good cause attributable to the work. Giving deference to the Appeal Tribunal's finding that Chen was not credible and that the testimony of the employer's representative that Chen was offered the choice to remain at work provided that he stopped taking pictures of other employees but if not, he would have to go home was credible, the panel affirms. This case demonstrates that an employee needs to establish "good cause" in order to leave work and still collect unemployment benefits.
